  • Orders mean a request by You to purchase Goods from Us.

  • Terms means these Terms and Conditions, which constitute the entire agreement between You and the Company.
  • Third-Party social media Service means any services or content provided by third parties and made available through the Service.
  • Website refers to Montvell LTD, accessible from https://montvell.myshopify.com/.
  • You means the individual or legal entity accessing or using the Service.

Acknowledgment

These Terms govern Your use of the Service and form a binding agreement between You and the Company. By accessing or using the Service, You agree to be bound by these Terms. If You do not agree with any part of the Terms, You must not use the Service.

You confirm that You are at least 18 years of age. The Service is not intended for use by persons under 18.

Your use of the Service is also subject to Our Privacy Policy, which explains how We collect, use, and protect Your personal information. Please review it carefully before using the Service.

Placing Orders for Goods

By placing an Order through the Service, You confirm that You are legally capable of entering into a binding contract.

Your Information

When placing an Order, You may be required to provide personal and payment information. You warrant that all information provided is accurate, complete, and lawful, and that You are authorised to use the chosen payment method.

By submitting this information, You authorise Us to share it with payment processing providers solely for the purpose of completing Your Order.

Order Cancellation

We reserve the right to refuse or cancel any Order at Our discretion, including but not limited to situations involving:

  • Goods availability
  • Errors in pricing or product descriptions
  • Suspected fraudulent or unauthorised transactions

Your Cancellation and Return Rights

Returns are governed by these Terms and Our Returns Policy, which forms part of this Agreement.

Goods must be returned in the same condition as received, including all original packaging, documentation, and accessories. Items that show signs of wear, damage, or alteration beyond inspection will not be refunded.

Approved refunds will be processed within 14 days of receipt of returned Goods, using the original payment method.

Non-returnable Goods

You do not have the right to cancel Orders for:

  • Bespoke or personalised Goods
  • Earrings or other Goods unsuitable for return due to hygiene reasons once unsealed
  • Goods that deteriorate rapidly or have expired
  • Goods inseparably mixed with other items after delivery
  • Digital content supplied without a tangible medium once performance has begun

This policy does not affect Your statutory rights under the Consumer Rights Act 2015.

Availability, Errors, and Inaccuracies

We endeavour to ensure all information on the Service is accurate and up to date; however, errors may occur. We reserve the right to correct inaccuracies, update information, or amend content at any time without prior notice.

Pricing Policy

Prices may be amended prior to Order acceptance. After acceptance, prices may be adjusted due to circumstances beyond Our control, including changes in duties, shipping costs, or exchange rates. In such cases, You will have the right to cancel the Order.

Payments

All Goods require full payment at the time of Order. We accept major debit and credit cards and approved online payment methods. Orders will not be processed without payment authorisation.

POA (Price on Application) Orders

Goods listed as POA are enquiry-only and do not constitute a confirmed Order. Montvell reserves the right to cancel any Order or enquiry containing POA items. All POA enquiries will be handled by Our administration team.

Links to Third-Party Websites

The Service may contain links to third-party websites or services. Montvell has no control over, and accepts no responsibility for, the content, policies, or practices of third-party sites.

Termination

We reserve the right to suspend or terminate access to the Service immediately, without notice, if You breach these Terms. Upon termination, Your right to use the Service will cease.

Limitation of Liability

To the fullest extent permitted by law, Montvell’s total liability shall not exceed the amount paid by You for the Goods or £100, whichever is greater. We shall not be liable for any indirect, incidental, or consequential losses.

“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind. We disclaim all implied warranties, including merchantability, fitness for purpose, and non-infringement, to the maximum extent permitted by law.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the United Kingdom. Any disputes shall first be addressed through informal resolution by contacting Montvell directly.

EU consumers retain all mandatory statutory rights available in their country of residence.

Severability and Waiver

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force. Failure to enforce any right shall not constitute a waiver.

Changes to These Terms

We reserve the right to amend these Terms at any time. Material changes will be notified were reasonably possible. Continued use of the Service constitutes acceptance of the revised Terms.
